LEGAL STATUS OF A PUBLIC KINDERGARTEN RUN BY A NON-PUBLIC ENTITY

Abstract

The study is an attempt to analyze the legal status of a public kindergarten established and run by the governing body, which is a private law entity. The analysis of the contemporary legal status is carried out on the basis of the historical queries of acts no longer in force. The following part of the article examines the current provisions of the educational law regarding the granting of permission to establish and operate a school (kindergarten). This is because according to the art. 88 section 4th acting a legal entity other than a municipal entity and a natural person may, after obtaining a permit, establish and operate a public school (kindergarten). In addition to the historical analysis of legal acts, the law is reviewed and discussed in terms of its substantive, procedural and legal and financial aspects. At the very end a summary and de lege ferenda conclusions are included.
